A patent is the exclusive right of the inventor over an invention in the field of technology to independently carry out or grant permission to others to carry out the invention for a certain period of time.
Understanding Invention
An invention is an idea of an inventor that is embodied in a specific problem-solving activity in the field of technology, which can be a product or process or an improvement and development of a product or process.
Simple Patents
Any invention in the form of a new product or tool that has practical utility value due to its form, configuration, construction, or components can obtain legal protection in the form of a simple patent.
Differences Between Patents and Simple Patents
Patents are granted for new inventions, contain inventive steps, and can be applied in industry. Meanwhile, simple patents are granted for any new invention, development of existing products or processes, and can be applied in industry. Simple patents are granted for inventions that are products that are not just different in their technical features, but must have a more practical function/utility than previous inventions due to their form, configuration, construction, or components that include tools, goods, machines, compositions, formulas, compounds, or systems. Simple patents are also granted for inventions that are new processes or methods.
The claims of a simple patent are limited to one independent claim, while the number of claims in a patent is not limited.
Technological progress in simple patents is simpler than technological progress in patents.
Inventions that can be patented
New. If at the time of patent application, the invention is not the same as previously disclosed technology.
Contains inventive steps. If the invention is something that could not have been anticipated by someone with specific skills in the technical field.
Can be applied in the industry. If the invention can be produced or used in various types of industries.
Patent Protection Period
Patents are granted for a period of 20 years from the date of patent application acceptance.
Simple patents are granted for a period of 10 years from the date of simple patent application acceptance.
